Barry McElduff and Richard Sedgwick defend in complex unlawful act manslaughter case

Barry McElduff and Richard Sedgwick were instructed to defend Ashley Lear who was charged with causing the death of Fuzel Miah.

The case involved complex issues of causation.

A trial took place in March 2025 involving detailed evidence from pathologists and neuropathologists called on behalf of the Prosecution.

Ultimately the jury could not agree upon a verdict.

Prior to a re-trial the Crown accepted a basis of plea that placed Mr Lear’s culpability in the lowest bracket within the sentencing guidelines and he was sentenced by the trial judge, Mr Justice Linden,  upon that agreed basis.

This resolution spared all parties in this tragic case the ordeal of a 2nd trial and meant that Mr Lear would be released from prison to begin rebuilding his life within weeks.
