An article by Steven Perian KC entitled “Third-Party Funding Costs After DTH v. DTF: Recoverability, Public Policy and the Malaysian Arbitration Framework” has been published in Current Law Journal.

The article examines why the legalisation of third-party funding does not necessarily resolve the separate question of recoverability. It considers the Singapore International Commercial Court decision in DTH v. DTF and its implications for Malaysia’s new arbitration funding framework under the Arbitration (Amendment) Act 2024, the Code of Practice for Third Party Funding 2026 and the AIAC Arbitration Rules 2026.

The article addresses practical issues for funded parties, respondents, funders and tribunals, including costs recovery, public policy, disclosure, privilege, security for costs and the funding waterfall.
