Barry McElduff’s client acquitted of samurai sword attempted murder allegation
At the conclusion of a 6 day trial at Southampton Crown Court Barry’s 16 year old client was acquitted of attempted murder.
The Defendant had attacked the victim using a samurai sword that had been bought on-line for the Defendant by a member of his family. The victim received multiple blows with the sword including at least one blow that transected three of their ribs, penetrating into their lung.
The issue at trial was whether the Defendant intended to kill the victim or just had the lesser accepted intention of intending to cause really serious harm.
