Barry McElduff’s client acquitted of all charges at conclusion of serious sexual offences trial

At the conclusion of a 9 day trial at Southampton Crown Court, Barry’s 22 year old client was acquitted of allegations that encompassed 21 separate allegations of rape and sexual violence.

The Prosecution relied upon not just the testimony of witnesses but also what they described as a contemporaneous narrative of texts, WhatsApp messages and Instagram messages in which they say the Defendant confessed to the crimes he was accused of.

In preparation for trial Barry was provided with 15,000 pages of messages between the Defendant and the Complainant; careful analysis and presentation of those messages established a counter narrative consistent with the defence case of consent that became the centrepiece of the defence case at trial.
