Lee Sergent persuades Court of Appeal to quash indecent assault conviction

R v G [2017] EWCA Crim 1774 reported in Crimeline Issue 85. Lee Sergent represented G at his original trial and had secured acquittals on a number of counts of sexual intercourse with a girl under 16.

G was, however, convicted of one count of indecent assault. Lee represented G at his appeal against that conviction. The Court of Appeal held that the conviction had been rendered unsafe by virtue of the Judge’s summing up in which he had made an error of law by referring to the complainant’s good character thus watering down the good character direction given in respect of G and because “the tendancy of the summing up was to undermine the credibility of the applicant and to enhance that of the complainant’ the appeal was allowed and the conviction was quashed.
