Islam Khan succeeds in notable case before the Immigration & Asylum Tribunal

Islam Khan successfully argued, on 25th May 2017, before the President of the Immigration and Asylum Tribunal, Mr Justice McCloskey and SIJ Plimmer that a supplementary decision by the SSHD whilst Judicial Review proceedings are ongoing are unlawful.

The panel also agreed that persecution of Landowners are identified in reliable objective materials and importantly the SSHD’s own policy on the security situation and avenue of redress for such claims. The SSHD failed to apply her mind to the Applicant’s specific circumstances: AW (Sufficiency of Protection) Pakistan [2011] UKUT applied. The SSHD’s decision was quashed.
