Adrian Fleming was instructed to prosecute the trial of a man accused of supplying nitrous oxide at a music festival. The trial ended with not guilty verdicts entered on direction by the Judge and has lead to a review of numerous other similar cases.
The trial was stopped by the trial Judge after the Court was informed that the Crown’s expert had formed the view that the substance is exempt from the legislation that was passed in order to combat the supply of legal highs. Adrian Fleming informed the Court that the CPS took the view that the case demanded ” a full review of the legislation”.
